This is a translation of the German original. In case of any discrepancies, the German version shall prevail.

EventButler is a brand of ButlerMedien GmbH. ButlerMedien GmbH operates the event portals eventbutler.ch and eventbutler.com and offers related communication services.

EventButler enables venue owners, event service providers and providers of event activities to present themselves professionally and effectively on the portal.

For event organisers, we offer innovative event portals with an individual, needs-based search for event venues, event service providers and event activities, making event planning simpler and more efficient.

Legal notice: By accessing information, details and documents on eventbutler.ch or eventbutler.com, you agree to the following terms.

A. Scope

ButlerMedien GmbH operates the event portals eventbutler.ch and eventbutler.com and offers related communication services. These General Terms and Conditions (hereinafter "T&C") govern the terms of use of the event portal and the contractual terms between customers and ButlerMedien GmbH in connection with paid services.

The T&C of ButlerMedien GmbH for the event portal apply to any use of the site by visitors. By clicking to accept the T&C and/or by using the site, you accept these T&C in full and acknowledge the following terms.

B. Terms of use

1. Copyright
The websites eventbutler.ch and eventbutler.com are the property of and operated by ButlerMedien GmbH. EventButler is a protected trademark registered with the Swiss Federal Institute of Intellectual Property in Bern. All trademarks, logos, images etc. of the listings on this website may not be used without prior written permission.

2. Use of the service
Visitors may use EventButler and the information it contains free of charge. This use is limited to the underlying purpose of the portal – the planning and organisation of events. It is prohibited to use, forward or sell content from this website for other commercial or non-commercial purposes, to modify the information or to use it in any other way. ButlerMedien GmbH accepts no responsibility for the completeness and accuracy of the listings posted.

3. Content of the service
ButlerMedien GmbH gives no warranty whatsoever for the timeliness, correctness, completeness or quality of the information provided. Liability claims against ButlerMedien GmbH relating to material or immaterial damage caused by the use or non-use of the published information or by the use of incorrect or incomplete information are excluded in principle, unless ButlerMedien GmbH is demonstrably guilty of intentional misconduct. ButlerMedien GmbH expressly reserves the right to change, supplement or delete parts of the content or the entire service, or to suspend publication temporarily or permanently.

Despite careful and regular checks, ButlerMedien GmbH accepts no liability for the content of the website itself or for external links. The operators of linked pages are solely responsible for their content.

ButlerMedien GmbH reserves the right to supplement or amend the terms of this agreement. It is the visitors' own responsibility to read and comply with these terms when visiting this website.

C. Contractual terms

1. General conditions
1.1 Commencement of the contract
The contract is concluded as soon as ButlerMedien GmbH has confirmed the customer's application to conclude the contract, submitted via online registration, orally, by telephone or in writing. ButlerMedien GmbH determines the start of use by the customer and the date the listing goes live.

The fees for paid services are shown in the online registration. Price adjustments to existing services or the introduction of new services are possible at any time. Price adjustments will be announced in advance. Customers can make changes to the content of their listings themselves at any time and free of charge.

1.2 Term of the contract
The contract is concluded for a term of 12 months (or as agreed). After the agreed term, it is automatically extended by a further 12 months unless it is duly terminated in writing at least 10 days before the end of the contract. Customers will be contacted by email in good time before the end of the term and may change, cancel or extend their subscription for another year.

1.3 Termination / notice period
Either party may terminate the contractual relationship in writing with 30 days' notice to the end of the agreed period.

2. Services of ButlerMedien GmbH
2.1 Availability of the portal
ButlerMedien GmbH endeavours to take all possible and reasonable measures to provide the agreed services smoothly. As the service partly relies on external IT systems whose operation is not within the responsibility of ButlerMedien GmbH, uninterrupted availability of EventButler at all times cannot be guaranteed.

ButlerMedien GmbH makes every effort to resolve any technical problems as quickly as possible. The customer will be informed of any service interruptions, maintenance work, the introduction of new technologies, etc. ButlerMedien GmbH endeavours to keep such interruptions short and, wherever possible, to schedule them at off-peak times.

2.2 Data security
ButlerMedien GmbH takes all necessary measures to secure its data. However, this is no guarantee that data can be restored after a loss. The customer is therefore responsible for backing up the data of their listing.

3. Obligations of the customer
3.1 Lawful use
A user account is created via online registration for entering listings. The customer is responsible for keeping the login details confidential and not passing them on. The customer undertakes not to misuse the services offered on the portal and to refrain from unlawful acts. The content and information accessible via EventButler (including images, logos etc.) are protected. The data may only be used in the form expressly approved by ButlerMedien GmbH or third-party providers, or with the express consent of the rights holder.

3.2 Duties to cooperate and refrain
The customer ensures that systems and devices in their possession that are used for the services of EventButler are protected against unauthorised access and manipulation. If the customer uses third-party services via the services of ButlerMedien GmbH, the customer is responsible for complying with their terms and may be held directly liable in the event of damage.

3.3 Publication of information by the customer
The customer undertakes that all content published by them or in their name (in particular texts, documents, videos, images etc.) complies with the statutory provisions. The customer assumes full responsibility for this content.

The customer is responsible for ensuring that all content they upload and publish on EventButler is free of third-party copyrights or does not infringe any third-party copyrights.

Should third parties assert claims for damages against ButlerMedien GmbH for copyright infringement in connection with listings entered by customers, the customer is obliged to compensate ButlerMedien GmbH for the damage incurred.

4. Warranty and liability
4.1 Principle
ButlerMedien GmbH is not liable to the customer or to the customer's contractual partners for any claims or claims for damages by third parties.

ButlerMedien GmbH is not liable for damage caused to the customer by third parties misusing the connection. Customers are solely responsible for the availability, accuracy and suitability of information and services on the internet. ButlerMedien GmbH accepts no responsibility for contractual or other relationships established via eventbutler.ch / eventbutler.com between customers or between customers and third parties.

4.2 Liability of the customer
The customer is liable to ButlerMedien GmbH for damage attributable in any way to the non-performance or poor performance of their contractual obligations, unless they can prove that they are not at fault. The customer undertakes to indemnify ButlerMedien GmbH against all third-party claims resulting from unlawful or improper use.

4.3 Payment terms / invoicing
The customer can choose between online payment (Mastercard, VISA, PayPal, Sofort bank transfer) and invoice for the agreed services. The respective obligations arise from the current price list or the individual agreement made with the customer. All prices are always exclusive of the applicable Swiss VAT. Unless otherwise agreed in writing, invoices are payable within 14 days of the invoice date. Listings are only activated by ButlerMedien GmbH once payment has been received.

Guidelines for providers 
For publishing listings on www.eventbutler.ch and www.eventbutler.com

We are pleased that you are interested in a listing on our websites. As a provider of an event venue, a service or team events for the events industry, you can present yourself professionally and directly to the target group – event organisers – on the event portal.

You can create listings directly online by opening a user account and clicking "Create listing". EventButler's pool includes more than 4,000 listings, which have been selected and added after extensive research and according to various quality criteria.

It is very important to us to keep the quality of EventButler high in the future and to provide our customers and users with an efficient and useful tool that makes event planning easier. For you as a provider, we do everything we can to offer an attractive platform where you can present your services effectively.

For these reasons, there are a few guidelines. Please read and follow them:

  • Please enter all content and categories truthfully and present yourself authentically
  • Your venue or service must be located in Switzerland, Germany, Austria or Liechtenstein
  • Your listing must include services for groups and be bookable for events
  • To be accepted on EventButler, your listing must offer added value for the events industry. The EventButler editorial team decides which listings are accepted
  • Please only use your own content and images for which you hold the copyright or the author's permission
  • Only use meaningful, high-quality images without advertising elements, lettering, URLs etc.
  • Write your listing so that it is tailored to the needs of event organisers
  • Describe your offer as completely as possible so that event planners can find you
  • Keep your details up to date and update your listing regularly
  • No URLs are allowed in the listing text or on images
     

Uniqueness and clarity of listings:

Uniqueness of listings: Each provider may only create one listing per location or service. If a provider wishes to specify several locations or additional places where their service is offered, this is only possible with a Premium listing. Creating several Basic listings to get around this is not permitted.

Clarity of information: Listing the same service or the same venue several times in different listings is prohibited. If a provider wishes to present different locations or services in different places, this must be done via a Premium listing.

Review and adjustment: The EventButler team reserves the right to review listings and to adjust or remove listings in the event of guideline violations.

Consequences of misuse: Providers who deliberately violate these guidelines may be excluded from the platform.

All entries are checked for quality and correctness by the EventButler team before they are activated. If the above guidelines are not followed, we reserve the right to correct incorrect information or to reject listings. The EventButler team carries out regular quality and timeliness checks and will remove inactive listings for quality reasons. We will of course inform you in all cases.

Guidelines for users
Comment guidelines for event organisers, users and visitors of EventButler

It is very important to us to keep all information on EventButler up to date, correct and useful for you, so that we can support you as well as possible in organising your event. For these reasons, the EventButler team makes great efforts and takes various measures that benefit you as a user.

One of our main goals is to keep the event portal up to date, "lively" and authentic. That is why we launched the EventBlog, where EventButler James regularly reports on current event offers and shares numerous tips & tricks. In the EventBlog, you can also like and comment on James's articles or forward posts to colleagues using the comment function.

Another important part of EventButler is the comment function on individual listings in the categories Venues, Service providers and Team events. The event portal should be "lively", and we are pleased when you share your own event experiences with the EventButler community.

There are a few guidelines to follow so that we can provide all customers and users of EventButler with an authentic and useful tool that makes event planning easier.

The comment function is intended to enable factual discussion, which may also be critical and emotional. The email address is not published and is only stored in connection with the comment. There is no right to publication.

  1. In the interest of a good culture of discussion, we reserve the right to edit or delete comments that contradict the following basic rules.

    • Comments relate to the individual post, as this is the only thing the author can respond to.
    • Comments are not submitted for search engine optimisation or to advertise commercial products or services.
    • Comments are not racist and do not spread hate propaganda.
    • Comments do not incite violence against persons, institutions or companies.
    • Comments do not contain pornography.
    • Comments do not insult or degrade any person.
    • Comments do not infringe third-party rights, in particular copyrights.
    • Comments do not call for demonstrations or rallies of any political orientation.
       
  2. If comments are deleted or edited, we will point out at least once that we have edited one or more comments. If your comment is not displayed but you cannot find a note from us, it is more likely that our spam filter has been triggered. In this case, please send us a short email.

  3. Apart from the cases mentioned above, we do not delete comments. Authors are responsible for their own words and, by submitting the comment, grant us an unrestricted right to publish what they have written. Comments on our posts reflect only the opinion of individual readers. EventButler gives no warranty whatsoever for the accuracy and completeness of the content. We do not enter into correspondence about published comments.

7. Supplementary provisions

7.1 Amendment of the terms and conditions
ButlerMedien GmbH reserves the right to amend these terms and conditions and the other conditions at any time. The amended provisions only take effect after the agreed contract term has expired. The amendments will be communicated to the customer in writing and are deemed accepted if the customer does not terminate the contract with ButlerMedien GmbH within 30 days of notification to the end of the agreed contract term.

7.2 Applicable law, place of jurisdiction
This contractual relationship is governed by Swiss law. The exclusive place of jurisdiction for any disputes arising from this contractual relationship is Bad Zurzach, unless a mandatory statutory place of jurisdiction applies.
